Terms of Service

1. Acceptance of Terms

By accessing or using Zlark (the "Service"), operated by TWOEPIC VENTURES (GSTIN: 27CZXPG5933Q1Z8), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

2. Service Description

Zlark provides AI-powered voice calling infrastructure, including outbound/inbound call automation, AI assistant creation, campaign management, and analytics. The Service is provided as Software as a Service (SaaS).

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately of any unauthorized access at support@zlark.co or +91 9976587658.

4. Subscription and Billing

4.1. Subscriptions are billed monthly in advance.

4.2. All prices are exclusive of GST (18%). GST is charged at prevailing rates per Indian law.

4.3. Subscription fees are non-refundable except as stated in our Refund Policy.

4.4. Failed payments trigger a grace period of 7 days after which services may be suspended.

5. Acceptable Use Policy

You agree NOT to use Zlark to:

  • Make calls to numbers on the National Do Not Call (DND) registry without proper consent
  • Transmit unsolicited commercial communications in violation of TRAI regulations
  • Impersonate individuals, government bodies, or financial institutions
  • Engage in harassment, threats, or any illegal activity
  • Violate any applicable local, state, national, or international law

5A. Unlawful Use — Client Responsibility & Legal Action

If the Service, or any AI agent created on it, is used for any illegal, fraudulent, or unlawful purpose, the entire responsibility for such use rests solely and exclusively with the client (account holder). TWOEPIC VENTURES acts only as a technology provider and bears no liability for the content, intent, or consequences of calls configured by clients.

  • You agree to fully indemnify and hold harmless TWOEPIC VENTURES, its directors, employees, and partners against all claims, damages, penalties, fines, and legal costs arising from your use of the Service.
  • On detection or credible report of unlawful use, we may immediately suspend or terminate the account and the offending AI agents without notice or refund.
  • We fully cooperate with law-enforcement agencies, courts, and regulators — including disclosure of account details, call recordings, transcripts, and logs as required by law.
  • Legal action may be initiated against the client by TWOEPIC VENTURES and/or affected parties, including criminal complaints under the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, and applicable TRAI regulations.

Compliance Review of AI Agents

Every AI agent created on the platform undergoes an automated compliance screening. Agents flagged for potential policy or legal violations are placed in "Pending approval" status and cannot make or receive calls until manually reviewed and approved by our compliance team. We may decline any agent at our sole discretion. This screening does not transfer any compliance responsibility from the client to TWOEPIC VENTURES.

6. Telephone Consumer Protection

You are solely responsible for compliance with the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), TRAI guidelines, and any applicable telemarketing laws. You must obtain proper consent before making automated calls.

7. Data Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms. We comply with the Digital Personal Data Protection (DPDP) Act, 2023.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by TWOEPIC VENTURES and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, TWOEPIC VENTURES shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or any activity we deem harmful to the Service or other users, with or without notice.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra.
